1. Acceptance of Terms
By accessing the US Chem website at uschem.mom (the Site) and purchasing our products, you agree to these Terms of Service. If you do not agree, do not use the Site or purchase products. These terms constitute a binding agreement between you and US CHEM GLOBAL LLC.
2. Products and Orders
All product sales are subject to availability. Prices are subject to change without notice. Orders are accepted subject to credit approval and product availability. Minimum order amounts may apply.
3. Pricing and Payment
Prices are FOB Hartford, Connecticut unless otherwise agreed. Payment terms are net 30 for approved credit accounts. All orders require a purchase order number. Applicable taxes are additional. Late payments incur interest at 1.5 percent per month.
4. Shipping and Risk of Loss
Risk of loss passes to buyer upon delivery to carrier. Buyer is responsible for receiving inspection and filing any damage claims with the carrier. Hazardous material shipping surcharges apply where required by DOT regulations.
5. Returns and Claims
Claims for damaged, short, or non-conforming product must be submitted within 5 business days of receipt. Returns require prior authorization and are subject to a 25 percent restocking fee. Custom or special-order products are non-returnable.
6. Limitation of Liability
US CHEM GLOBAL LLCs liability for any claim arising from the sale or use of our products is limited to the purchase price of the product. We are not liable for indirect, incidental, consequential, or punitive damages including production downtime or lost profits.
7. Intellectual Property
All website content including text, images, and product descriptions is the property of US CHEM GLOBAL LLC.
8. Governing Law
These terms are governed by the laws of the State of Connecticut. Disputes shall be resolved in Hartford County, Connecticut.
9. Changes to Terms
We reserve the right to modify these terms. Changes are effective upon posting. Continued use constitutes acceptance.
